Terms of Service for Guided Minds Futures Wheel sessions

Introduction

Welcome to Guided Minds Futures Wheel sessions ("Service"). The Service is provided by Guided Minds ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our Service, so please read them carefully.

1. Acceptance of Terms

By accessing or using our Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

2. Description of Service

Guided Minds Futures Wheel sessions are designing to be ‘plug and play’ 30-90 minute sessions to create a futures wheel for business leaders and training professionals to incorporate into strategy and training workshops. The participant experience during the session is supported by a purpose-built companion app that allows participants to record observations and access their team’s summarised observations.

3. User Accounts

To use our Service, you must register for a facilitator account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Participants will not need a user account to access the companion app. Participants can access the companion app through a unique URL or QR code that you (as the facilitator) provide. Any users that receive your session’s unique URL or QR code will be able to submit responses and potentially view responses from other participants in your session – it is your responsibility to ensure that your session’s unique URL and QR code are only shared with session participants.

4. License Grant and Restrictions

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business use. You agree not to use the Service for any illegal purpose or in any manner inconsistent with these Terms.

5. User Conduct

You are responsible for all activities that occur under your account. You agree not to:

  • Engage in any activity that interferes with or disrupts the Service.

  • Use the Service to violate any applicable law or regulation.

You are also responsible for the conduct of participants from your session while they use the companion app, including the content and nature of their responses.

6. Intellectual Property Rights

All intellectual property rights in the Service, its content, and all underlying technology are owned by us or our licensors. Except for the rights expressly granted under these Terms, no other rights are granted, either express or implied.

7. Data Policy

We collect and use your data according to our Privacy Policy, which forms part of these Terms. We take the protection of your data seriously and implement security measures to safeguard it.

8. Payment and Fees

Access to the Service is granted upon a one-time payment for a session license.

Your payment will provide participant access to the companion app on a predefined date, for a predefined period of time, for a predefined number of participants. Participants will have access to their team’s responses for a predefined period of time following your session. These amounts will be communicated to you prior to and during purchase.

All payments are non-refundable except as expressly provided in these Terms.

9. Service Availability and Support

We strive to ensure that the Service is available, but we do not guarantee uninterrupted or error-free operation. We provide customer support for issues related to the Service.

10. Termination and Account Cancellation

We reserve the right to suspend or terminate your account if you violate these Terms. You may cancel your account at any time via the Service's interface or by contacting us directly.

11. Modifications to Terms and Service

We may modify these Terms or the Service at any time. We will notify you of any changes by posting the new Terms on our website or through the Service.

12. Disclaimer of Warranties and Liability

The Service is provided "as is" without any warranties, express or implied. We do not warrant that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be resolved through arbitration in New South Wales, Australia.
